SUPERCITY TOWING’S TERMS AND CONDITIONS

These Terms and Conditions apply to all towing, storage, recovery, impound and related services provided by Supercity Towing. By requesting services from Supercity Towing, or by parking a vehicle on private property where parking terms, conditions, or towing warnings are displayed, vehicle owners and drivers acknowledge and accept these Terms and Conditions.

 

Storage Rates

Storage fees apply to all vehicles held at any Supercity Towing yard and are charged on a daily basis.

Storage charges are determined by operational costs associated with securely storing vehicles, including property, insurance, staffing, security, compliance, and administration expenses. Storage rates are set at Supercity Towing’s discretion and are applied consistently across all stored vehicles.
 

Current daily storage rates are:
 

  • $48.50 incl. GST for standard cars and vans

  • $97.00 incl. GST for trailers, caravans, and trucks
    (truck storage charges may vary depending on vehicle size and storage requirements)

Storage fees continue to accrue until the vehicle is collected and all outstanding charges have been paid in full.
 

Storage charges commence from the time the vehicle arrives at the storage facility. Any part-day may be charged as a full day.
 

Storage rates are subject to change without notice.

 

Vehicle Release
 

Vehicles will only be released once:
 

  • Full payment has been received and cleared

  • Valid photo identification has been provided

  • Proof of ownership or authority to collect the vehicle has been provided to Supercity Towing’s satisfaction
     

Supercity Towing reserves the right to refuse release where ownership or collection authority cannot be reasonably verified.

 

Payment Terms
 

All towing, storage, recovery, administration, and associated charges must be paid in full prior to vehicle release unless otherwise agreed in writing.
 

Accepted payment methods are subject to change at Supercity Towing’s discretion.
 

Any overdue accounts may be referred to a debt collection agency, and additional collection or legal costs may be added to the outstanding balance.
 

Vehicles may not be removed from Supercity Towing premises until all applicable charges have been paid in full.

 

Belongings in Vehicle
 

Where possible, Supercity Towing’s drivers do not enter vehicles during the towing process.
 

Vehicle owners are responsible for removing all personal belongings from their vehicle. Supercity Towing accepts no responsibility or liability for any personal property left inside a vehicle, including any loss of or damage to such items while the vehicle is in transit or storage.
 

Any access to a vehicle, whilst in our care, for the collection of personal belongings is at Supercity Towing’s discretion and may require proof of ownership and photo identification.
 

Supercity Towing reserves the right to refuse access to or remove hazardous, illegal, or unsafe items from vehicles where required by law or safety obligations.

 

Access to Stored Vehicles

Access to vehicles stored at Supercity Towing facilities is strictly by prior approval, by appointment, and during operating hours only.
 

Photo identification and proof of ownership will be required before access is granted.

 

Vehicle Damage Claims

1. Any claim for alleged vehicle damage must be reported to Supercity Towing immediately upon collection of the vehicle, or no later than 24 hours after the vehicle has been released.
 

This timeframe is necessary to allow Supercity Towing a reasonable opportunity to inspect and assess the alleged damage and determine whether any liability exists.
 

2. When submitting a damage claim, the claimant must provide:

  • A clear description of the alleged damage

  • The exact location of the damage on the vehicle

  • Clear supporting photographs, including:

    • Close-up images showing the detail of the alleged damage; and

    • Wider images showing the damage in context on the vehicle

 

Supercity Towing may request additional information or documentation where required.
 

Failure to report the alleged damage within the required timeframe, or failure to provide sufficient supporting information, may result in the claim being declined.
 

Supercity Towing is not responsible for pre-existing damage, mechanical failure, electrical faults, deterioration, or issues arising from the condition, age or modifications of the vehicle prior to towing or storage.
 

Vehicles with lowered suspension, body modifications, aftermarket kits, or mechanical defects are transported at the owner’s risk unless otherwise agreed in writing.

 

Appeals
 

When a vehicle is parked on private property, the property owner or their authorised agent may enforce the parking terms and conditions applicable to that site.
 

Before submitting an appeal, please consider the following:

  1. Whether you were authorised to park your vehicle on the property

  2. Whether you reviewed any signage, parking restrictions, or time limits displayed on site

  3. By entering and parking on private property, motorists acknowledge and accept the parking terms and conditions displayed on the signage, including any applicable enforcement action, towing charges, storage fees, and associated costs arising from a breach of those conditions

  4. If you do not agree with any of the T&C’s, warnings or notices on the property, you must remove your vehicle immediately
     

If, after considering the above, you wish to lodge an appeal, this must be submitted in writing within 28 days of the vehicle’s release.
 

Appeals can be submitted:

 

Please include:

  • Your full name and contact details

  • Vehicle registration number

  • Date of tow/release

  • Supporting documentation or evidence relevant to your appeal

 

Supercity Towing will endeavour to respond to appeals within a reasonable timeframe, however response times may vary depending on the complexity of the matter.

Disposal of Vehicles & Contents
 

Supercity Towing reserves the right to retain possession of a vehicle and contents until all towing, storage, and associated charges have been paid in full.
 

If a vehicle remains unclaimed or outstanding charges remain unpaid for thirty (30) days, Supercity Towing may commence disposal procedures in accordance with applicable New Zealand legislation and industry processes.
 

Vehicles left unclaimed for thirty (30) days, will continue to incur storage charges until the date of disposal.
 

Prior to any disposal, reasonable efforts may be made to contact the registered owner or any interested party using the details available.
 

If a vehicle is disposed of, any proceeds received from the sale, wrecking, or scrap value of the vehicle may be applied toward the outstanding balance owing on the account.
 

Where the proceeds do not satisfy the full amount outstanding, the remaining balance may be referred to a debt collection agency for recovery. Any additional collection, administration, or legal costs incurred may also be added to the outstanding balance.

 

Limitation of Liability
 

To the maximum extent permitted by law, Supercity Towing shall not be liable for:

  • Loss of use of the vehicle

  • Consequential or indirect loss

  • Mechanical or electrical failure not caused by Supercity Towing’s negligence

  • Delays caused by traffic, weather, emergencies, or circumstances beyond Supercity Towing’s control

 

Nothing in these Terms excludes any rights that cannot legally be excluded under New Zealand law.

 

Dangerous Goods
 

Supercity Towing reserves the right to contact Police or relevant authorities if any dangerous, prohibited, stolen, or illegal items are discovered within a vehicle.

 

CCTV and Surveillance
 

Supercity Towing premises may be monitored by CCTV and audio or visual recording systems for safety, security, training, investigative, and operational purposes.

By entering Supercity Towing premises, individuals acknowledge and consent to such recording where permitted by law.

 

Privacy
 

Supercity Towing may collect, use, and disclose personal information for the purposes of providing towing and storage services, verifying ownership, debt recovery, responding to disputes, and complying with legal obligations.
 

Information may be shared with enforcement agencies, property owners, insurers, debt collection agencies, or other authorised parties where permitted by law.

 

Right to Refuse Service
 

Supercity Towing reserves the right to refuse service, refuse vehicle access, or require any person to leave its premises where staff reasonably believe there is a risk to safety, security, property, or compliance obligations, including threatening, abusive, intoxicated, or unlawful behaviour.
